These GTC govern the contractual relationship between POZZIBLE AG and its customers for the ordering of goods via the Internet on the online store www.pozzible.ch. POZZIBLE AG performs all sales exclusively on the basis of these GTC. With the purchase of the goods, the customer agrees to these GTC as the exclusive contractual basis. Any additional agreements between POZZIBLE AG and the customer require a written agreement.

As soon as the customer confirms his order at the end of the online ordering process by clicking the button “order with obligation to pay”, his order is binding for POZZIBLE AG. The purchase contract between POZZIBLE AG and the customer is concluded after POZZIBLE AG sends the customer an e-mail confirming the order to the e-mail address provided by the customer.

If the ordered product or part of the ordered products are not available from stock, Pozzible AG will inform the customer accordingly. The ordered goods will always be delivered later. Furthermore, in such a case POZZIBLE AG has the right to reject the order or to reduce the order quantity, whereby a contract for the reduced order quantity is concluded between the customer and POZZIBLE AG. If the customer informs POZZIBLE AG immediately that he is not interested in the reduced order quantity, no contract is concluded.

POZZIBLE AG has the right to refuse an order at any time, especially if the customer has not paid due invoices or if there is a legal dispute with the customer.

All prices are quoted in Swiss francs (CHF) and include VAT and any discounts.

POZZIBLE AG only delivers its products within Switzerland. The minimum order amount is CHF 5. POZZIBLE AG endeavors to deliver the products to the address specified by the customer within two to three working days of the order being placed.

The products are sent via Swiss Post. Shipping may be delayed (e.g. manufacturer has delivery problems, Swiss Post is overloaded, etc.). Any claims for damages by customers due to delays in delivery caused by third parties and their consequences are excluded. POZZIBLE AG can only be held liable for delays in delivery in the event of gross or negligent breach of contract. Delivery is deemed to have taken place upon handover to the post office. The benefit and risk of the products are transferred to the customer upon delivery to Swiss Post.

For orders up to CHF 120, the customer pays the indicated shipping costs. In the case of partial deliveries, the indicated costs will only be charged once. For orders over CHF 120, shipping is free of charge for private customers.

Payment is made by credit card using the credit cards specified in the order process, Paypal or, if indicated, by invoice (payable within 10 days) with the delivery of the goods.

The delivered products remain the property of POZZIBLE AG until the purchase price and delivery costs have been paid in full. POZZIBLE AG has the right to enter the retention of title in the retention of title register at the domicile of the customer concerned.

POZZIBLE AG guarantees that the products are properly stored and delivered in their original packaging. Any further warranty is, as far as legally possible, expressly excluded. All products sold by POZZIBLE AG are subject to strict controls by the manufacturer. Therefore, only the respective manufacturer of a product is liable for the quality, properties and effects of his products. POZZIBLE AG is not liable to the customer for any complaints or complications.

The customer must inspect the ordered products for any defects immediately upon receipt. POZZIBLE AG must be notified in writing of any immediately recognizable defects within 5 days at the latest (e-mail is sufficient).

If POZZIBLE AG recognizes a defect as such, it will supply a replacement for the product in question. Purely incorrect orders cannot be returned.

Only credit cards (Visa, Mastercard) are accepted for subscription orders. As soon as a subscription is purchased, POZZIBLE AG will automatically charge the customer’s credit card at the frequency selected by the customer. The subscription is automatically renewed unless deactivated 24 hours before the current subscription expires.

No activation fee is charged for a subscription. The subscription can be canceled at any time via the customer account (My account(/subscriptions/delete). The amount of the next extension will therefore no longer be charged.

The customer can agree an annual subscription with POZZIBLE AG for the regular delivery of products. The subscription costs must be paid by the customer in advance. Annual subscriptions can be canceled in writing (by e-mail is sufficient) with a notice period of one month to the end of a month. In the event of termination, the customer shall receive a pro rata refund of the subscription costs for the remaining months after the premature termination of the subscription period to an account to be specified by the customer. If the customer is absent abroad for a longer period of time, subscription deliveries can be suspended after prior consultation with POZZIBLE AG. If a product included in the subscription is no longer offered by POZZIBLE AG during the subscription period, the customer will be informed accordingly. If possible, the old product is replaced with another suitable product.

The customer can redeem one voucher per order. To do this, the customer must enter the voucher code in the field provided at the end of the order process. The amount of the voucher will be deducted directly from the total amount of the order. Vouchers that exceed the order amount cannot be refunded.

POZZIBLE AG complies with the provisions of the Swiss Data Protection Act (DSG). Personal data is only obtained or processed to the extent necessary for business transactions. The customer authorizes POZZIBLE AG to use his personal data to maintain the customer relationship, for example in the context of marketing campaigns. The detailed

POZZIBLE AG has the right to adapt these GTC to changed circumstances at any time. The adjustments are immediately applied to new customer orders.

Swiss law is applicable to the contractual relationship between the customer and POZZIBLE AG. The place of jurisdiction shall be determined in accordance with the rules of the Swiss Code of Civil Procedure (ZPO).
